Terms & Conditions

1. Payments for our basketball court must be made in cash, cashier’s check, money order or credit card.
2. Court reservations are strictly for the specified times in this agreement and renter shall coordinate so that all activity is timely ceased prior to the end time so that the court can be cleaned and timely delivered to the next patron. Renter fully understands that its failure to end the scheduled activity at the designated time will result in additional fees of $25.00 for each 5-minute increment exceeding the scheduled end time or possible termination of their rental agreement.
3. Cancellation Policy: cancellations shall be subject to the following fees and forfeiture:
   1. $20.00 per reservation if the cancelation is more than 15 days prior to the event
   2. 50% of the rental price if the cancellation is between 5 and 14 days prior to the scheduled event
   3. 100% of the rental price will be forfeited if cancellation of the rental is made 0-4 days prior to the event
4. Waiver of Liability: Vibe BQE is not responsible for the loss or damages of any equipment, supplies or property belonging to the renter/occupant or attendees.
5. Insurance Requirements and Indemnity: The renter/occupant shall carry no less than $1 million in liability insurance and name Vibe Fitness as an additional insured party. The renter/occupant shall indemnify and hold harmless Vibe Fitness from and against any claims, damages, losses, or expenses, including but not limited to attorney fees, which arise out of or in any way relate to, any and all personal injury, death and/or property damage in connection with their use of Vibe Fitness. This includes any act or omission by Vibe Fitness, their representatives, and employees.
6. Renter shall be responsible to enforce, monitor and ensure that all of its guests, invitees, players, etc. comply with all Vibe Fitness rules policies and procedures and to include without limitation the following:
   1. All guests must sign a Liability Waiver Form prior to entering the facility
   2. Access is solely for the Court, Café and Restroom facilities
   3. NO ACCESS TO GYM OR OTHER AREAS OF THE FITNESS CLUB
   4. NO ACCESS TO PARKING LOTS WHICH ARE SOLELY FOR MEMBERS
   5. NO food allowed in the court areas
   6. Proper attire required
   7. Renter shall not use the facility for the sale of any food or beverage which shall be strictly operated by the Vibe Fitness
7. Renter represents and certifies that all information provided in this application is true and correct. Vibe Fitness reserves the right to cancel usage of the facility for cause on immediate notice to the renter and upon 14 days’ notice without cause, if in the sole and absolute discretion of the club, the facility is needed for other purposes. Vibe Fitness upon cancellation will return any deposits, if applicable.
8. This agreement is not binding upon Vibe Fitness unless the renter/occupant has signed it; paid in full all deposits and fees and is signed by the designated representative of Vibe Fitness.
